1. About these terms
These terms apply to coaching sessions booked with Etienne Ralph, trading as Etienne Ralph Boxing (Waterloo, Sydney), through this website. No payment is taken online: you book or enquire here, and payment is arranged directly with Etienne. By booking a session, you agree to these terms. Nothing in them excludes, restricts or modifies any consumer rights you have under the Australian Consumer Law that cannot lawfully be excluded.
2. Booking & sessions
- Coaching is one-on-one, by appointment, at Bondi Boxing Club, 3 Allen St, Waterloo NSW 2015.
- Sessions run 30, 45 or 60 minutes and are provided with due care and skill.
- If you arrive late, the session still finishes at its scheduled time.
- You bring your own gear: gloves, wraps and a mouth guard (head gear if needed). Equipment is available for purchase at the gym.
- Clients under 18 may only be booked in by a parent or guardian, who must sign the risk warning, waiver and medical screening form and be present at the first session.
3. Pricing & payment
- Prices are in Australian dollars (AUD). Etienne Ralph Boxing is not currently registered for GST; no GST applies to the prices shown.
- No payment is taken through this website. Payment is arranged directly with Etienne by cash, bank transfer or PayID.
- Packs and blocks are paid upfront and valid for 5 months from purchase.
4. Cancellation, no-shows & refunds
- To cancel or reschedule a session at no charge, give at least 24 hours' notice.
- Sessions cancelled with less than 24 hours' notice, and no-shows, may be counted as used. Genuine emergencies are considered case by case.
- Change-of-mind purchases (including unused pack sessions) are not refundable, except where the Australian Consumer Law requires otherwise.
- You have guarantees under the Australian Consumer Law that cannot be excluded, including that services are provided with due care and skill and within a reasonable time. Where we fail to meet a consumer guarantee, you may be entitled to a remedy.
5. Programs & memberships
Digital training programs and memberships are not currently sold or billed through this website. If they are offered online in future, their terms (including any recurring billing and how to cancel) will be added here.
6. Health, risk warning & waiver
Boxing is a physically demanding contact sport and a dangerous recreational activity within the meaning of the Civil Liability Act 2002 (NSW). It carries inherent and obvious risks, including impact injuries, cuts, bruising, fractures, concussion and, in rare cases, serious or permanent injury. By training, you acknowledge and accept these risks.
Before your first session you will be asked to complete a medical screening form and to sign a separate risk warning and waiver. You agree to disclose relevant medical conditions and injuries before training, and to follow all reasonable safety instructions given during sessions. Nothing in these terms excludes liability that cannot lawfully be excluded, including for a failure to provide services with due care and skill.
7. Liability
To the maximum extent permitted by law, and subject to your non-excludable rights under the Australian Consumer Law and the Civil Liability Act 2002 (NSW):
- our liability for any claim arising out of or in connection with the coaching services or this website is limited, at our election, to resupplying the services or paying the cost of having them resupplied;
- we are not liable for indirect or consequential loss, or for loss caused by your failure to disclose a relevant medical condition or to follow reasonable safety instructions;
- participation in training is also subject to the separate signed risk warning and waiver.
Nothing in this clause excludes, restricts or modifies the consumer guarantees or any other rights that cannot lawfully be excluded.
8. Disputes, changes & governing law
If you have a problem, contact us first via the support page; we aim to resolve issues within 14 days. You may also contact NSW Fair Trading. We may update these terms; the version in force is the one published here at the time of your booking. These terms are governed by the laws of New South Wales, Australia, and disputes are subject to the courts of New South Wales.
